For Freelancers
At Mertus we maintain a large network of companies and freelancers and gather a diverse selection of attractive projects and qualified professionals.
Freelancers can apply for these projects through us. We support our freelancers in the application process and help to create an ideal fit between company and freelancer. Our goal is to provide an all-round service for freelancers that is individual, efficient and legally compliant.
The Mertus team stands at your side with advice and support from the very beginning. There are no limits to the variety of questions and tasks that may arise. We are happy to assist you with the application process, help you with pricing and settle all questions concerning the project work as well as billing.
With the help of Mertus’ competent external partners, we can also provide you with answers to questions concerning topics such as insurance, retirement provisions, taxes, etc.
No, the publication of your personal profile on the Mertus website is completely free of charge for you.
If you are successful as an applicant with our customer, Mertus will conclude a contract directly with you. You will work as a subcontracted independent contractor for us at our customer. All questions concerning contracts, billing, etc. you will discuss exclusively with Mertus.
No, you are explicitly not bound to Mertus. As an independent contractor, you are completely free to choose your clients, customers and projects. However, if you are assigned to one of our clients, we will regularly agree on competition and customer protection clauses customary in the market with regard to the respective specific client.
The use of freelancers is subject to strict restrictions which may lead to legal risks, if not mitigated accurately, especially on the company side. Compliance is therefore a major issue.
In order to prevent problems regarding so-called “pseudo self-employment”, it is important to observe a few basic rules. It starts with your personal appearance as an independent company. Do you have your own website, business cards, etc.? Obviously, special attention must also be paid to the drafting of contracts. Here it is not only important to avoid certain vocabulary, but in particular to formulate the contract so concretely that you can ideally fulfil it “on your own”, i.e. without further instructions. Last but not least, you need to consider important aspects in the context of your work with the customer. Here, too, a wide range of topics can become relevant: Corporate benefits, employee discounts and work equipment are just a few of them!
If you wish, we will be happy to advise you on these aspects and report from our own experience. Simply get in touch with us.
You can find our notes on these topics underDatenschutz and AGB.
No, unfortunately Mertus cannot offer legal and/or tax advice. However, if you wish, we can refer you to experienced experts from our network.
Nevertheless, we use our legal know-how in advance and thus try to set up an ideal, legally secure and compliant framework for your activity.
AnIT liability insurance is advisable for many reasons. On the one hand, many clients require that freelancers provide proof of insurance coverage. This is often also stipulated in the contract. On the other hand, insurance also provides protection for private assets if a liability case should occur.
As a provider, we recommend our Mertus cooperation partner exali.de. In addition to special expertise in the IT and consulting field, you will receive through Mertus attractive special conditions, including 10% special discount on the insurance premium in the first year.
For Companies
Mertus maintains a large network of companies and freelancers and gather a diverse selection of attractive projects and qualified professionals.
If you wish, the Mertus team will support you in the first step by defining your specific project and your needs. This is the crucial starting point for a successful search for suitable freelancers.
You can publish your project on the Mertus website. There, our freelancers can take a look at your project and find out whether they can offer the skills demanded and imagine working with you. Of course, we also search for professionals on other platforms and contact suitable candidates from our network.
We will send you suggestions on potential freelancers and will also be happy to support you in selecting the perfect candidate for your project. In addition to professional assessments, we attach great importance to the personal fit to your team. Our goal is to provide our clients with an all-round service that is fast, efficient and legally compliant.
We stand at your side with advice and support from the very beginning. There are no limits to the variety of questions and tasks that may arise. Simply contact us personally for any inquiries.
To post a new project on the Mertus website, you must first create a company profile. You can then post a project in your personal area.
In addition to the core information about the schedule, budget and location, you will need a precise description of the project. If you have any questions or need help publishing your project, please feel free to contact us.
No, the publication of your project is completely free of charge for you.
You commission us with the procurement of specialists for your project and we bring suitable freelancers to work for you. A contractual relationship therefore exists exclusively between Mertus and your company. There is no direct contract between you and the freelancer.
After you have decided on a particular professional, we conclude corresponding project contracts with the freelancer.
Unless otherwise stipulated in the contract, services rendered are documented in detail with regard to time and subject of the service. Invoicing is done on a monthly basis, with the freelancer submitting the respective service records to you at the end of each month.
After reviewing and approving the service record, Mertus will invoice you for the services provided by us.
For all questions regarding the use of the freelancer in your company, you have an individual contact person at Mertus. You will be able to discuss all questions concerning the project with this person.
The use of freelancers is subject to strict restrictions that can entail legal risks, if not mitigated accurately. Compliance is therefore a topic of considerable importance.
In order to prevent problems regarding so-called ” pseudo self-employment” and consequences under labour law, important principles must be observed.
This is already relevant in the selection of suitable candidates as well as the review of the conditions of their self-employment. Equally important, of course, is the drafting of the contracts on the basis of which freelancers are deployed by our clients. In addition to simply avoiding certain vocabulary, it is particularly important to make the contracts as concrete as possible. The goal must be that the freelancer can ideally fulfil the commissioned services without further instructions. Finally, practical rules for dealing with external specialists must be established and observed. A wide range of topics can become relevant here: What work equipment is used? From where does the freelancer work? What kind of access card does the freelancer receive to the company’s premises and at what price can freelancers eat in the company’s own canteen?
If you wish, we will be happy to advise you on these aspects and report from our own experience. Just get in touch with us.
You can find our notes on these topics underPrivacy Policy and GTCs.
